1. Acceptance of Terms

By accessing or using the GymViz platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

GymViz provides a cloud-based gym management platform that includes member management, biometric access control integration, automated billing, analytics, and communication tools.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access
  • One account per gym location unless on a multi-branch plan

4. Subscription & Payments

  • Subscriptions are billed monthly or annually as selected
  • Prices are in USD and exclude applicable taxes
  • Payment is processed through our secure payment partners
  • Failed payments may result in service suspension after a 7-day grace period
  • Refunds are available within 14 days of initial purchase for new customers

5. Free Trial

New customers receive a 14-day free trial with full feature access. No credit card is required for the trial. Service access is automatically suspended at trial expiration unless a paid plan is activated.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code or attempt to breach security
  • Share account credentials with unauthorized users
  • Reverse engineer or attempt to extract source code
  • Resell or sublicense the Service without written consent
  • Use the Service to process data of individuals without their consent

7. Data Ownership

  • You retain ownership of all data you input into GymViz
  • You grant us a limited license to process your data to provide the Service
  • You can export your data at any time through the platform
  • Upon account termination, we delete your data within 30 days

8. Biometric Data Compliance

If you use biometric features, you are responsible for:

  • Obtaining informed consent from members before biometric enrollment
  • Displaying appropriate signage at biometric collection points
  • Complying with local biometric data laws (e.g., GDPR, UAE Data Protection Law)
  • Providing members with opt-out alternatives (e.g., QR code or RFID card)

9. Service Availability

We strive for 99.9% uptime. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control, including internet outages, natural disasters, or third-party service failures.

10. Limitation of Liability

To the maximum extent permitted by law, GymViz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.

11. Termination

Either party may terminate the subscription at any time. Upon termination:

  • Your access to the platform will cease at the end of the current billing period
  • You may export your data within 30 days of termination
  • All biometric data will be permanently deleted

12. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
